In these Terms & Conditions the following words have the following meanings:-

"the Company" means Mr L Terrell trading as Real Outfitting,

"Design" means any design, logo, drawing, art work, supplied in any medium including printed matter or electronic form.

All illustrations and descriptions contained in the Company's brochures, catalogues, advertisements, website or price lists are approximate only and are intended merely to give a general idea of the goods or services. The goods or services supplied may vary slightly from those illustrated or described.

For technical reasons exact colour matches between batches of goods supplied may not be possible but the tone or colour of goods supplied will be broadly similar to those advertised.

These Terms and Conditions apply to all purchases of Goods from the Company whether from its Website, by telesales, facsimile, e-mail or otherwise.

If the design is supplied to purchaser then it is the sole responsibility of the purchaser to ensure that the supplied design is free from error, of adequate resolution and suitable for the intended purpose. The Company shall not be liable for any losses claims, damages, costs or expenses suffered by the Purchaser resulting from any error or inaccuracy in such Design.

The Purchaser warrants and represents that any Design work supplied to the company by the purchaser shall not cause the Company to infringe any third party Intellectual Property rights. The Purchaser shall indemnify the Company against any and all claims, actions, costs, expenses, brought against the Company in respect of any infringement of any third party Intellectual Property rights as a result of the use of the supplied Design or artwork.

The Company shall not be liable for any loss, damage or other deficiency in the order Unless the Company is informed of the nature of the lose or deficiency within seven days of the delivery of the goods or provision of the service.

No design work will be accepted if it is of a racist, illegal or blasphemous or grossly offensive nature, or any other design deemed to be unsuitable buy the company for any reason whatsoever.

Any time or date given for delivery of the Goods or provision of services given by the Company shall be taken as an estimate made by the Company in good faith, but shall not be binding upon the Company.

Ownership of the Goods shall remain solely with the Company until such time as the Purchaser has paid to the Company the agreed price in full and cleared funds for all the Goods or services.

As all goods are made specifically for each customer goods cannot be returned and no refund will be given unless the goods are defective or at variance to a material degree from those ordered.

No permission to copy or reproduce designs or artworks featured on the Website, brochures advertisements or similar materials is given. In particular nothing on the companies website may be reproduced for use in any publication, or distributed for any purpose without the prior written consent of the Company.

Where the Website is hyperlinked to any site operated by any third party, the Company accepts no responsibility or liability in respect of any produce, service, material or information on such site. The presence of such sites shall not be deemed to be a commendation or endorsement of such site by the Company.

The Company shall be entitled to delay or cancel delivery or to reduce the amount of the Goods delivered if it is prevented from, hindered or delayed in supplying, obtaining or delivering the Goods by normal route or means of delivery through circumstances beyond its reasonable control, including but not limited to, strikes, lock-outs, accidents, war, fire, reduction in or unavailability of power at manufacturing plant, breakdown of plant or machinery or shortage or unavailability of labour and raw materials from normal source of supply and the Company shall not be responsible to the Purchaser for any resulting loss or damage suffered by the Purchaser.

These Terms and Conditions and any Contract shall in all respects be governed or construed in accordance with laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
